Welcome to the MyQPortal. The MyQPortal is owned and maintained by EdQuiddity Inc., and is subject to the following terms of use ("the Terms of Use"):

User Agreement

Each visitor to the MyQPortal ("the User") is encouraged to review the Terms of Use. By using the MyQPortal, the User is agreeing to comply with the Terms of Use, and to comply with all applicable laws. The Terms of Use cannot be changed by the User. If the User does not agree to the Terms of Use, then the User may not use the MyQPortal.

Scope

The Terms of Use apply exclusively to the MyQPortal, accessible at www.MyQPortal.com.

Amendments

EdQuiddity Inc. may amend the Terms of Use at any time without notice. It is the responsibility of the User to periodically review the Terms of Use for changes. When amendments are made, the "revised" date at the top of the Terms of Use will be amended accordingly. Your continued use of the MyQPortal after an amendment constitutes your acceptance of the amendment.

License

Except as may be otherwise noted, the content and format of the MyQPortal is the exclusive property of EdQuiddity Inc., and EdQuiddity Inc. maintains all of its copyright, trademark, and proprietary rights. EdQuiddity Inc. grants the User a non-exclusive revocable license to access the MyQPortal in accordance with the Terms of Use and to use the resources for instructional and professional development purposes at the Userís school. If and to the extent that MyQPortal content is printed or transmitted by the User, all EdQuiddity Inc. indicia of ownership and rights appearing on the content must be maintained, and the MyQPortal must be cited as the source. In no event, however, may MyQPortal content be copied or used for purposes other than related to instructional and professional development at the Userís school.

Termination of License

Upon termination of or lapse of Userís school subscription, the User must immediately cease and desist from using any of the resources from the MyQPortal that User may have downloaded, saved, printed, or otherwise reproduced physically or digitally. All such materials in the Userís possession must be immediately destroyed by the User.

No Warranty; Disclaimer

EdQuiddity Inc. is not responsible for errors or omissions in content on the MyQPortal or obtained through the use of the MyQPortal website, or for the improper or incorrect use of information obtained on or through the MyQPortal. EdQuiddity Inc. makes no warranty that content on the MyQPortal is free from copyright claims or other restrictions or limitations on free use or display. THE CONTENT PROVIDED ON OR THROUGH THE MyQPortal IS PROVIDED "AS-IS" WITH ALL FAULTS OR DEFECTS. EDQUIDDITY INC. Userid and Password Use

EdQuiddity Inc. provides the User with a userid and password for educational use by teachers, paraprofessionals, and administrators. Under no circumstances is the User to provide that userid and password to those outside of the Userís school or to students, parents, community members, or others not employed by the school.

General Copyright

Except as may be otherwise noted, the content and format of the MyQPortal is the exclusive property of EdQuiddity Inc., and EdQuiddity Inc. maintains all of its copyright, trademark, and proprietary rights.

Trademark Notice

The Learner-Active, Technology-Infused Classroom™ is a registered trademark of EdQuiddity Inc.

Notice of Copyright Infringement

If a User believes that MyQPortal content infringes a valid copyright, the User is requested to notify the Site Administrator and to include the following information: a description of the copyrighted material that the User claims to have been infringed; a description of the MyQPortal website location(s) where the material at issue can be found; the Userís name, address, telephone number, and email address; and the Userís relationship to the copyright owner. The Site Administrator is identified at the end of this document.

Links to Other Websites

For your convenience, the MyQPortal may contain links to other websites of interest that are not owned, controlled, or managed by EdQuiddity Inc., including social media sites. These non-EdQuiddity Inc. websites are subject to their own terms of use, and not to this Terms of Use. The User is encouraged to review the Terms of Use of each website visited. EdQuiddity Inc. cannot guarantee the accuracy, relevance, timeliness, or completeness of material on non-EdQuiddity Inc. Websites, and disclaims any liability relating to the content of such websites.

Links from Other Websites

Other websites may link to MyQPortal non-Subscriber webpages. The linking site must not remove or obscure EdQuiddity Inc. proprietary notices, must not "frame" the MyQPortal website or otherwise suggest that the content is not the property of EdQuiddity Inc., and must not contain material that is illegal, inappropriate for educational purposes, or offensive in the sole judgment of EdQuiddity Inc.. The link must be removed immediately and without objection upon EdQuiddity Inc.ís request, which may be for any reason or for no reason. Other websites may NOT link to MyQPortal Subscriber webpages or content (of any kind).

Indemnification

The User agrees to indemnify, defend, and hold harmless EdQuiddity Inc. and its employees from any claim and expense (including court costs and attorneyís fees) incurred as a result of the Userís violation of the Terms of Use.

Users Under 13

The MyQPortal is not directed at children under the age of 13. If you are younger than 13, please do not provide any personally identifiable information in connection with your use of this Web site

Governing Law, Jurisdiction, and Venue

The Terms of Use is governed by the laws of the State of New Jersey, without regard to any conflict of laws provisions. The User agrees that that the courts of New Jersey shall have jurisdiction over any action relating to the Terms of Use or the MyQPortal.
